Important Information About Arizona's Healthy Schools Act

Dear FUSD Families,

Beginning with the 2026–2027 school year, Arizona's Healthy Schools Act (House Bill 2164) introduces new requirements regarding foods that may be served, sold, or shared with students during the regular school day. The Arizona Healthy Schools Act is intended to support healthier school food environments by limiting students' exposure to specific food additives during the school day. Schools across Arizona are required to comply with the law beginning in the 2026–27 school year and will certify their compliance with the Arizona Department of Education.

The law prohibits schools from serving, selling, or distributing foods containing certain additives during the school day, including through:

  • School breakfast and lunch

  • Vending machines

  • Snack bars and school stores

  • Classroom celebrations and parties

  • Fundraisers

  • Any other food shared or distributed to students on campus during the school day

The restricted additives include:

  • Potassium bromate

  • Propylparaben

  • Titanium dioxide

  • Brominated vegetable oil

  • Yellow Dye 5 and Yellow Dye 6

  • Blue Dye 1 and Blue Dye 2

  • Green Dye 3

  • Red Dye 3 and Red Dye 40

What this means for families

Food that your child brings from home for their own personal lunch or snack is not affected by this law.

However, food brought to school to share with other students—including birthday treats, classroom party snacks, or celebration foods—must comply with the Healthy Schools Act and cannot contain the restricted additives.

To help families plan ahead, we've attached the following resources:

  • Approved Snack List – A list of snack and beverage options that meet the requirements of the Healthy Schools Act.

  • Birthday Snack Request Form – The form to complete if you would like to provide a birthday snack for your child's class with assistance from Food and Nutrition Services. 

FUSD Nutrition Services and school staff are working together to ensure compliance while continuing to provide safe, nutritious, and enjoyable food options for students.
